Family sues after toddler chokes on used condom

A toddler choked on a used condom and swallowed the contents before his mother could retrieve it from his mouth while the family was staying at a Mount Laurel hotel, according to a federal lawsuit filed last week.

Steven and Amy Wolfe of Massachusetts and their three children are suing Homewood Suites by Hilton Mount Laurel and other affiliated companies for unspecified damages related to the Jan. 3 incident at the Homewood Suites on Nixon Drive.

The 22-month-old boy was sitting on a pullout sofa in Room 142 when his mother, tending to another child in the bathroom, heard him choking. The family was staying at the all-suites hotel on its way back from Fort Myers, Fla., after visiting family over the holidays.

"She was horrified to discover that [the child] had been chewing on (and was choking on) a used condom which had been overlooked by housekeeping after they purportedly cleaned, sanitized and otherwise prepared the suite," the suit read.

The 15-count complaint alleges the hotel subjected the boy to "dangerous, hazardous, life-threatening and potentially fatal health hazard+placing him at increased risk to contract sexually transmitted diseases, including HIV and AIDS, or some other serious, life-threatening potentially fatal illness."

The suit also contends the hotel failed to follow proper procedures and failed to properly hire, train and supervise its housekeeping staff. It also alleges Hilton failed to maintain a reasonably safe environment, exposing the family to "offensive, noxious and disgusting conditions."

According to the complaint, the child, his parents and two young siblings all have suffered severe emotional stress, great pain and mental anguish from the incident.
The toddler also will have to undergo "a battery of invasive and painful testing and diagnostic procedures to monitor his condition, diagnose future illness and seek a cure," the suit claims. It alleges the family will have to spend "great sums of money" for that medical intervention.

A representative from Homewood Suites could not be reached for comment Monday. The case has been assigned to U.S. District Judge Joseph Rodriquez in Camden.
